This is an agreement between you and Bonvue (including its affiliates, “Bonvue” or “we”). Please read these Bonvue Services Terms of Use, the Bonvue Privacy Notice, and other applicable rules, policies, and terms available on the Bonvue website or through the Bonvue Mobile App (collectively, this “Agreement”) before using the Bonvue Services on your device.
By using the Bonvue Services, you agree to be bound by the terms of this Agreement on behalf of yourself and all members of your household and others who use Bonvue Services under your account. If you do not accept the terms of this Agreement, then you may not use the Bonvue Services and you may return your Product in accordance with any applicable return policy.
For the purpose of these Bonvue Services Terms of Use:

“Bonvue Software” means all software/firmware we make available to you for use on a Product and the associated Mobile App.

“Digital Content” means digitized content (including user-generated content), such as photos, videos, captions, and related features and functionality.

“Product” means the Bonvue Digital Photo Frame device.

“Bonvue Services” means the provision of Bonvue Software, cloud storage, mobile application connectivity, customer support, and other services that we provide Product users.
1. Bonvue Services & Software
a. Use of Bonvue Services. To use Bonvue Services on a Product, you must have your own Bonvue account (via the Mobile App), be logged in to your account, and connect your Product to the Internet. You are responsible for maintaining the confidentiality of your account and password.
b. License to Use. Subject to your compliance with this Agreement, Bonvue grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to access and use the Bonvue Services and Software solely for personal, non-commercial use on the Product.
c. Cloud Services & App Sync. Your Product relies on cloud services to synchronize photos and videos from your mobile device to the frame. When you upload Digital Content, we process your files to resize, optimize, and deliver them to your Product. You retain all rights to your Digital Content. By using the Services, you grant Bonvue a limited license to store and display this content on your designated Product(s).
2. Connectivity and Availability
a. Internet Connectivity. Bonvue Services require a Wi-Fi Internet connection to receive updates and new content. You are responsible for any fees, restrictions, and terms imposed by your Internet service provider.
b. Availability. Some Bonvue Services may be unavailable, vary by device or geography, be offered for a limited time, or undergo maintenance without prior notice.
3. General
a. Information Received. The Bonvue Software may provide us with information about your Product, use of the Product, and use of Digital Content (such as storage usage, error logs, network connectivity, and device settings). We will handle any information we receive in accordance with the Bonvue Privacy Notice.
b. User Responsibility. You are solely responsible for the Digital Content you display on the Product. You agree not to upload content that is illegal, obscene, threatening, defamatory, or infringes on the intellectual property rights of others.
c. Changes to Services; Amendments. We may change, suspend, or discontinue the Bonvue Services, or any part of them, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on our website or app. Your continued use of Bonvue Services after the effective date of the revised Agreement constitutes your acceptance of the terms.
d. Termination. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Bonvue may immediately revoke your access to the Bonvue Services (including cloud syncing).
e. Disclaimer of Warranties and Limitation of Liability. The Product and Bonvue Services are provided on an "AS IS" and "AS AVAILABLE" basis. Unless otherwise required by applicable law, in no event will our aggregate liability with respect to any claim arising from or related to this Agreement or your use of the Bonvue Services exceed the amount you actually paid for the Product. We do not guarantee that the services will be uninterrupted or error-free.
